Privacy Policy
This Privacy Policy explains how Markovate.com Inc. ("appsstore.ai," "we," "us") collects, uses, shares, and protects personal information when you visit our website, create an account, install the Agent, or use our on-demand expert Service. It works alongside our Terms of Service, Cookie Policy, and Data Processing Addendum.
1Controller & data roles
For personal information about you as a visitor or account holder (your name, email, billing details, and usage), we act as the controller.
When Experts access personal data that lives inside your systems, code, or databases in order to do work you request, we act as a processor on your behalf — you are the controller of that data. That relationship is governed by our Data Processing Addendum. This Privacy Policy describes the data for which we decide the purposes.
2Information we collect
| Category | Examples | Source |
|---|---|---|
| Account | Name, email, password hash, organization, role | You |
| Billing | Plan, purchase history, billing address, tax ID, last-4 and card brand (full card data handled by our processor) | You, payment processor |
| Project & session | Project metadata you connect, chat messages with Experts, approvals, actions taken, time metered | You, the Agent |
| Customer Content | Code, files, logs, and data you expose through the Agent for work | Your systems (processed as a processor — see §1) |
| Usage & device | IP address, browser, device, pages viewed, referrer, timestamps, diagnostics | Automatic |
| Communications | Support requests, survey responses, emails | You |
We do not intentionally collect special-category personal data (such as health or biometric data) about you. Please do not send it to us unless necessary and lawful.
3How we use your information
- To provide, operate, and staff the Service, including connecting you with Experts and metering time;
- To process payments, manage subscriptions, and prevent payment fraud;
- To communicate with you about your account, security, and changes to the Service;
- To provide support and respond to your requests;
- To maintain security, prevent abuse, and enforce our Terms and Acceptable Use Policy;
- To improve the Service and develop new features, using aggregated or de-identified data where practical;
- To send marketing communications where permitted — you can opt out at any time; and
- To comply with law and enforce our legal rights.
We do not sell your personal information, and we do not use your Customer Content to train third-party AI models. [Confirm and keep this accurate to your actual practices.]
4Legal bases (EEA / UK)
If you are in the European Economic Area or the United Kingdom, we rely on: performance of a contract (to provide the Service you signed up for); legitimate interests (to secure, improve, and market the Service, balanced against your rights); consent (for certain cookies and marketing, which you can withdraw); and legal obligation (for tax, accounting, and compliance).
5How we share information
We share personal information with:
- Experts — see Section 6;
- Service providers / subprocessors — hosting, payment processing, analytics, email, customer support, and communications tools that process data on our behalf under contract. See our Subprocessors list;
- Professional advisers — auditors, lawyers, and insurers, as needed;
- Authorities — where required by law, legal process, or to protect rights, safety, and property; and
- Corporate transactions — an acquirer or successor in a merger, financing, or sale of assets, subject to this Policy.
We do not sell personal information, and we do not "share" it for cross-context behavioral advertising as those terms are defined under US state privacy laws. [Confirm against your actual ad/analytics setup.]
6Sharing with Experts
To perform the work you request, we share relevant project information, chat context, and the access you approve with the specific Experts staffed to your session. Experts are bound by confidentiality and data-protection obligations and may only use what they access to perform your requested work. You control the scope and duration of access through the Agent's approval and revocation controls.
7Cookies & similar technologies
We and our providers use cookies and similar technologies to operate the site, remember preferences, measure usage, and (where you consent) support marketing. See our Cookie Policy for details and choices.
8International data transfers
We and our providers and Experts may process your information in countries other than yours, including [the United States]. Where we transfer personal data out of the EEA, UK, or other regions with transfer restrictions, we use an approved mechanism such as the European Commission's Standard Contractual Clauses (and the UK Addendum), or another valid safeguard. Contact us for a copy of the relevant safeguards.
9Data retention
We keep personal information only as long as needed for the purposes above, then delete or de-identify it. In general: account and billing records are kept for the life of your account and for [X years] afterward to meet tax and legal obligations; chat and session logs are kept for [X months]; and diagnostic logs for [X days]. Customer Content is retained per your instructions and the DPA and can be deleted on request, subject to legal limits.
10Security
We use technical and organizational measures designed to protect personal information, including encryption in transit, access controls, least-privilege access for Experts, and the outbound-only, approval-based Agent design. No system is perfectly secure; you are responsible for safeguarding your account credentials and for what you expose and approve through the Agent. We will notify you and regulators of qualifying data breaches as required by law.
11Your privacy rights
Depending on where you live, you may have rights to access, correct, delete, port, and restrict or object to the processing of your personal information, and to withdraw consent. To exercise these, contact privacy@appsstore.ai. We will verify your request and respond within the time the law requires. You may also complain to your data-protection authority (in the EEA/UK) — though we hope you'll contact us first.
12US state privacy rights
If you are a California resident (or in another US state with a comparable law), you may request access to, deletion of, and correction of your personal information, and information about our processing, and you may appeal a denial. We do not sell your personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of on that basis; if that changes, we will provide a "Do Not Sell or Share My Personal Information" mechanism. We will not discriminate against you for exercising your rights. You may use an authorized agent, subject to verification.
13Canadian privacy rights (PIPEDA and provincial laws)
Markovate.com Inc. is based in Ontario, Canada, and handles personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. If you are in Canada, you may:
- access the personal information we hold about you and ask us to correct it;
- ask about our collection, use, and disclosure of your personal information;
- withdraw consent, subject to legal or contractual restrictions and reasonable notice; and
- make a complaint to us and, if unresolved, to the Office of the Privacy Commissioner of Canada (or your provincial regulator, such as under Quebec's Law 25).
We collect, use, and disclose personal information for the purposes described in this Policy and rely on your consent (express or implied) or another lawful basis permitted under Canadian law. To exercise these rights or reach our privacy contact, email privacy@appsstore.ai or write to us at the address below. Because we and our providers may process data outside Canada (see International transfers), your information may be subject to the laws of those countries.
14Children
The Service is not directed to children under 18, and we do not knowingly collect their personal information. If you believe a child has provided us information, contact us and we will delete it.
15Changes to this policy
We may update this Policy. We will post the new version with a revised "Last updated" date and, for material changes, notify you. Your continued use after the effective date means you accept the updated Policy.
